5. Purchase of Products and Returns Policy

The Gamer Realm may, at its discretion, provide a refund for a change of mind within 7 days of purchase, provided the Product packaging is unopened and in a saleable condition. You are liable for all postage and shipping costs associated with a change-of-mind refund.

 

6. Warranty

 

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.

  • Warranty Period: You may make a warranty claim for material defects within 30 days from the date of purchase.

  • Exclusions: The warranty does not apply to products that have been damaged or defaced, subjected to misuse, abnormal service, or altered in design or construction.

 

7. Delivery

 

Our Purchase Services integrate delivery through third-party companies ('Delivery Service Providers'). We facilitate your interaction with these providers but are not the provider of the delivery services.

In the event that an item is lost or damaged during delivery, we ask that you:

  1. Contact the Delivery Service Provider directly to request a refund or claim on any available insurance.

  2. Contact us at info@thegamerrealm.com to inform us of the issue so we can assess the performance of our Delivery Service Providers.

  • Termination by You: You can terminate the Terms by notifying The Gamer Realm in writing and closing your account.

  • Termination by The Gamer Realm: We may terminate the Terms with you if you breach any provision, if we are required to by law, or if providing the service is no longer commercially viable.

 

12. Indemnity

13. Dispute Resolution

 

  • Compulsory: If a dispute arises, a party may not commence court proceedings (except for urgent relief) until this process has been followed.

  • Resolution: Upon receiving the notice, both parties must endeavour in good faith to resolve the dispute through negotiation within 14 days. If the dispute is not resolved within 30 days, the parties must agree upon a mediator.

  • Mediation: The mediation will be held in Sydney, Australia. The parties are equally liable for the fees of the mediator.

 

14. Governing Law and Jurisdiction

 

The Terms are governed by the laws of New South Wales, Australia. In the event of any dispute, you agree that the exclusive venue for resolving the dispute shall be in the courts of New South Wales.

 

15. Severance

 

If any part of these Terms is found to be void or unenforceable by a court, that part shall be severed, and the rest of the Terms shall remain in force.
